These Terms of Use are a legal agreement between you and INGCorporated, Inc. d/b/a xHockeyProducts.ca ("xHockeyProducts," "we," "us," or "our"). They govern your access to and use of xHockeyProducts.ca, including browsing the site, creating an account, requesting a quote, and placing an order. By using the site, you agree to these Terms. If you do not agree, please do not use the site.

1. Acceptance of These Terms

Your use of the site constitutes your acceptance of these Terms of Use, our Privacy Policy, and any additional terms presented at checkout or on a quote. These documents together form the entire agreement between you and xHockeyProducts regarding the site. If any provision is found unenforceable, the remaining provisions stay in full effect.

Nothing in these Terms limits any rights you have under applicable provincial consumer protection legislation, including the Ontario Consumer Protection Act and the Quebec Consumer Protection Act. If these Terms conflict with consumer rights that cannot be waived under the law of your province or territory, that legislation prevails.

2. Eligibility

The site is intended for users who are at least the age of majority in their province or territory of residence. By placing an order you represent that you meet this requirement and that you have the legal authority to enter into a binding contract, including on behalf of any rink, facility, team, school, or organization you represent.

3. Your Account

You may browse and purchase without an account, but some features require one. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Provide accurate, current information and update it as needed. Notify us promptly through the Contact Us page if you suspect unauthorized use of your account. We may suspend or close accounts that violate these Terms.

4. Product Information, Pricing, and Errors

We work hard to describe our products accurately, but we do not warrant that product descriptions, specifications, images, availability, or pricing are error-free. All prices are in Canadian dollars unless stated otherwise. Colors and finishes may vary from what your screen displays, and specifications for facility products may be updated by manufacturers.

If a product is listed at an incorrect price or with incorrect information, we reserve the right to correct the error and to refuse or cancel any order placed at the incorrect price, even after order confirmation. If your payment has already been charged for a cancelled order, we will issue a full refund to your original payment method.

Written quotes issued by our team are valid for 30 days from the date of issue unless the quote states otherwise. Pricing on custom and freight-quoted products may change after a quote expires.

5. Orders and Payment

Your order is an offer to purchase. We may accept or decline any order at our discretion, and an order is not accepted until we send a shipping confirmation or, for quote-based products, until we issue a written order confirmation. We may limit quantities, cancel orders that appear fraudulent, and require verification before acceptance.

Standard catalog items can be purchased through the online cart. Custom, oversized, and freight-shipped facility products, such as rink systems, dasher boards, backyard rinks, and ProWall systems, are sold on a quote basis through our Request a Quote process, and may require a signed quote acceptance and deposit before production begins.

Payment is processed at checkout by third-party payment processors. You represent that you are authorized to use the payment method you provide. Applicable GST/HST/PST and shipping charges are calculated and shown before you submit your order.

Quotes, Deposits, and Custom Builds

Facility products such as dasher boards, rink systems, and dressing rooms are typically sold through a written quote. Quotes are valid for 30 days unless stated otherwise. Custom-built and made-to-order products may require a deposit before production begins, and because they are built to your specifications, they cannot be cancelled or returned once production has started, except as required by applicable consumer protection legislation or as stated in your quote. Where installation is included, the scope of installation, site-readiness requirements, and any additional charges will be described in your quote or order confirmation.

6. Shipping and Risk of Loss

Shipping methods, transit times, and freight delivery procedures, including curbside delivery and inspection requirements for freight shipments, are described on our Shipping page. Unless otherwise stated in writing or required by applicable consumer protection legislation, title and risk of loss pass to you when the carrier accepts the shipment. Please note visible damage on the delivery receipt before signing for freight shipments.

7. Returns and Refunds

Returns are governed by our Returns & Refunds policy, which is incorporated into these Terms. Custom-built and made-to-order products are generally not returnable except where defective. Please review the returns policy before ordering.

8. Warranty

Eligible products are covered by our 90-day Built for Players™ Warranty against defects in materials and workmanship, as described on the Warranty page. Some products also carry manufacturer warranties, which are provided by the manufacturer and not by us. These warranties are in addition to, and do not limit, the legal warranties and remedies available to you under applicable provincial consumer protection legislation.

9. Intellectual Property

All content on the site, including text, graphics, logos, photographs, product images, page layouts, and software, is owned by or licensed to INGCorporated, Inc. and is protected by Canadian and international copyright laws. You may view, download, and print pages for your personal, non-commercial use, including placing an order or requesting a quote. Any other reproduction, distribution, or commercial use requires our prior written permission.

xHockeyProducts, Built for Players™, and related names, logos, and slogans are trademarks used by INGCorporated, Inc. Other marks appearing on the site belong to their respective owners. Nothing on the site grants any license to use any trademark without the owner's written consent.

10. Acceptable Use

You agree not to misuse the site. Among other things, you may not: use the site for any unlawful purpose; attempt to gain unauthorized access to our systems or interfere with the site's operation; scrape, harvest, or copy site content or pricing data by automated means; submit false or fraudulent orders or quote requests; impersonate any person or entity; or upload content that is unlawful, infringing, defamatory, or abusive. We may suspend access for violations of this section.

11. Reviews and User Content

If you submit reviews, photos, comments, or other content to the site, you grant xHockeyProducts a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, edit, and display that content in connection with our business, including on the site and in marketing materials. You represent that your content is your own, is accurate, and does not violate anyone's rights. We may remove or decline to post any user content at our discretion, and we are not responsible for content submitted by users.

12. Third-Party Links and Services

The site links to services operated by third parties, including quote forms hosted on Jotform, payment processors, shipping carriers, and partner sites. These services have their own terms and privacy policies, and we do not control and are not responsible for their content or practices. You access third-party sites and services at your own risk.

13. Disclaimers

The site and its content are provided "as is" and "as available." To the fullest extent permitted by law, xHockeyProducts disclaims all warranties, conditions, and representations regarding the site, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free. This section does not limit the product warranties described in Section 8 or any rights that cannot be excluded under applicable consumer protection legislation.

Hockey and athletic training involve inherent risk. Products should be installed, anchored, and used according to the instructions provided and with appropriate supervision.

14. Limitation of Liability

To the fullest extent permitted by law, xHockeyProducts and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the site or products purchased through it. Our total liability for any claim arising out of these Terms or your use of the site will not exceed the amount you paid us for the product or service giving rise to the claim.

Some provinces and territories do not allow certain exclusions or limitations of liability in consumer transactions. Where applicable consumer protection legislation prohibits a limitation in this section, that limitation does not apply to you, and our liability is limited to the greatest extent the legislation permits.

15. Indemnification

You agree to indemnify, defend, and hold harmless INGCorporated, Inc. and its officers, employees, and agents from and against claims, losses, damages, and expenses, including reasonable legal fees, arising from your violation of these Terms, your misuse of the site, or content you submit.

16. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Subject to any mandatory rights you have under the consumer protection legislation of your province or territory, you agree that the courts of the Province of Ontario have jurisdiction over any dispute arising out of or relating to these Terms, the site, or any purchase, and you attorn to the jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The current version, with its effective date, will always be posted on this page, and material changes will be highlighted on the site or communicated by email where appropriate. Continued use of the site after changes take effect constitutes acceptance of the revised Terms. Orders are governed by the Terms in effect when the order is placed.
